General Terms and Conditions

Introduction

These are the terms and conditions of service for www.writersandartists.co.uk (Website). The Website is operated by Bloomsbury Publishing PLC (we, us and our). We are registered in England and Wales under company number 01984336 and have our registered office at 50 Bedford Square, London WC1B 3DP. We are a member of the Publishers Association. Our VAT registration number is GB 215039103.

Your use of the Website will be subject to these terms and conditions, whether as a guest or a registered user, and by using the Website you agree to be bound by them. Any services you order from the Website are supplied subject to our Website Terms of Service. Any products that you buy on the Website will be subject to the Bloomsbury Terms of Sale.

We reserve the right to change these terms and conditions from time to time by changing them on the Website.  These terms and conditions were last updated on 2nd March 2021.

You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these General Terms may also be superseded by provisions or notices published elsewhere on the Website. Furthermore, the provision and use of services offered on the Website are subject to the Terms of Service as therein provided and applicable in addition to these General Terms.

Please read these General Terms carefully before you start to use the Website. By using the Website, you indicate that you accept these General Terms and that you agree to abide by them. If you do not agree to these General Terms please refrain from using this Website.

The Website is intended for use only by persons who are at least 13 years of age. By using the Website, you confirm to us that you meet this requirement and that, if you are under the age of 18, you have received permission from your parent or guardian before using the Website.

Accessing the Website

Access to the Website is permitted on a temporary basis and we reserve the right to withdraw or amend the service we provide on the Website without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period.

From time to time, we may only allow access to some parts of the Website, or the entire Website, to users who have registered with us.

To register, you must provide us with accurate, complete and up-to-date contact information, including name, postal address, telephone number and email address. You are responsible for the information you provide to us. You must promptly update your account information online in the event of any changes to this information. Registration is subject to approval by us in all cases, and we reserve the right, in our sole and absolute discretion, to decline any application for registration, without giving a reason.

If you are registering as an organisation, rather than in your personal individual capacity, you must have the necessary authority, power and right fully to bind the legal entity or organisation on whose behalf you wish to be granted access to the Service(s) ordered. If you are not authorised to bind that legal entity or organisation, you must not attempt to register. By registering, you represent and warrant to us that you are duly authorised.

If you choose, or you are provided with a username, password or any other piece of information as part of our registration and security procedures, you must treat such information as confidential, and you must not disclose it to any third party.  You are responsible for all activities that occur under your username and must notify us immediately of any unauthorised use or other security breach of which you become aware.

We have the right to disable any username or password, whether chosen by you or allocated by us, at any time and to terminate your registration at any time without notice to you, if in our opinion you have failed to comply with any of the provisions of these General Terms or if any details you provide for the purposes of registering as a user prove to be false.

You are responsible for making all arrangements necessary for you to have access to the Website. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these General Terms and that they comply with them.

We cannot guarantee the continuous, uninterrupted or error-free operability of the Website. There may be times when certain features, parts or content of the Website, or the entire Website, become unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion, without notice to you.  You agree that we will not be liable to you or to any third party for any unavailability, modification, suspension or withdrawal of the Website, or any features, parts or content of the Website.

We cannot and do not guarantee that any content of the Website will be free from viruses and/or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content.

What you are allowed to do

You may only use the Website for non-commercial use unless you have obtained a licence from us and only in accordance with these General Terms. You may retrieve and display content from the Website on a computer screen, print and copy individual pages and, subject to the next section, store such pages in electronic form. Additional terms may also apply to certain features, parts or content of the Website and, where they apply, will be displayed on-screen or accessible via a link.

You may download and print extracts from material on the Website for your own personal and non-commercial use only. You must not download or print the material or extracts from it in a systematic or regular manner or otherwise so as to create a database in electronic or paper format comprising all or part of the material appearing on the Website. You may not distribute, transmit or disseminate any part of the material on the Website without our prior written permission.

What you are not allowed to do 

Except to the extent expressly set out in these General Terms, you are not allowed to: 

  • 'scrape' content or store content of the Website on a server or other storage device connected to a network or create an electronic database by systematically downloading and storing all of the content of the Website; 
  • remove or change any content of the Website or attempt to circumvent security or interfere with the proper working of the Website or the servers on which it is hosted.

You must only use the Website and anything available from the Website for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates.

You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs, spyware, adware or other material which is malicious or technologically harmful or designed to adversely affect the operation of the Website or of any computer software or hardware relating or connecting thereto. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.

All rights granted to you under these terms and conditions will terminate immediately in the event that you are in breach of any of them.

Intellectual property rights

Unless otherwise stated, we are the owner or the licensee of all intellectual property rights in the Website, and in the material published on it. For the purposes of these General Terms, “material” means material including, without limitation, text, software, photographs, graphics, images, trademarks, logos, and video and sound material. Those works are protected by copyright and other intellectual property laws and treaties around the world. All such rights are reserved. Except as expressly set out here, nothing in these General Terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the Website.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

You must retain all copyright and other proprietary notices appearing on the Website and you must not use any part of the materials on the Website for commercial purposes without obtaining a licence to do so from us and/or our licensors.

If you print off, copy or download any part of the Website in breach of these General Terms, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

We aim to update the Website regularly, and may change the format and content of the Website from time to time. You agree that your use of the Website is on an 'as is' and 'as available' basis and at your sole risk. If the need arises, we may suspend access to the Website or close it indefinitely. Any of the material on the Website may be out of date at any given time, and we are under no obligation to update such material.

Whilst we try to make sure that all information contained on the Website (other than any user-generated content) is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information. 

User content

The Website may, from time to time, allow you to upload user-generated content and may also allow you to communicate that content, either to selected recipients or in public areas, such as comments pages, blogs, chat rooms, message boards, and/or forums (collectively User Content Areas). We do not control the material submitted to User Content Areas (collectively User Submissions), nor are User Content Areas actively moderated. You are solely responsible for the content of your User Submissions as submitted by you and acknowledge that all User Submissions express the views of their respective authors, and not our views.

If you participate in any User Content Areas, you must:

  • keep all User Submissions relevant to the purpose of the User Content Area and the nature of any topic;
  • not submit any User Submission that is unlawful, threatening, abusive, libellous, pornographic, obscene, vulgar, indecent, offensive or which infringes on the intellectual property rights or other rights of any third party;
  • not submit any User Submission that contains any viruses and/or other code that has contaminating or destructive elements;
  • not submit any User Submission containing any form of spam and/or advertising; and
  • not impersonate, or misrepresent an affiliation with, any person or entity or create and/or any user accounts that contain false or misleading information.

You agree that, by submitting any User Submission, you grant us and our affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, distribute, perform and display such User Submission (in whole or part) and/or to incorporate it in other works in any form, media or technology, and you waive any moral rights you may have in, or to be identified as the author, of such User Submission.

Whilst we do not pre-screen User Submissions, we reserve the right, in our sole discretion, to delete, edit or modify any User Submission submitted by you and/or to close any topic, at any time without notice to you.

Complaints about the content of any User Submission must be sent to writersandartists@bloomsbury.com. and must contain details of the specific User Submission giving rise to the complaint.

Content standards

These standards (as further described in the Community Guidelines) apply to each part of any User Submissions as well as to its whole.

User Submissions must:

  • Be accurate (where they state facts)
  • Be genuinely held (where they state opinions)
  • Be original to you
  • Comply with any applicable law worldwide and in particular in the UK and in any country from which they are posted.

User Submissions must not:

  • Be obscene, offensive, hateful, inflammatory, incite violence or contain sexually explicit material;
  • Advocate, promote or assist any illegal activity of any kind;
  • Be defamatory or any person or violate another person’s privacy rights or otherwise contain unlawful material;
  • Infringe any copyright, database right or trade mark of any other person or party;
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • Give the impression that they emanate or are endorsed by us, if this is not the case; and
  • Falsely endorse any goods or services.

The area of the Website where registered users can submit details of their profile is intended for individual profiles and not company profiles or information.

Uploading or submitting material to the Website

Whenever you make use of a feature that allows you to upload or submit material to the Website, or to make contact with other users of the Website, you must comply with the content standards. You warrant that any such contribution does comply with those standards and you indemnify us for any breach of that warranty.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Website.

Any material including any User Submissions you submit may be published on the Website or within associated marketing materials. We further reserve the right to remove any material or posting you make on the Website if, in our sole discretion, such material or User Submissions do not comply with the content standards set out above.

You acknowledge and agree that when you post User Submissions, you are doing so at your own risk. You acknowledge and agree that the views expressed by you and other users by way of User Submissions are made independently of and do not reflect the views of Writers and Artists, Bloomsbury, or any of our affiliates. We do not support or endorse any User Submissions.

Our liability

While we endeavour to ensure that the information provided on the Website is accurate and up to date, the material displayed on the Website (whether provided by us or a third party) is made available without any guarantees, conditions, warranties or representations as to its accuracy, completeness or reliability. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

  • All conditions, warranties, representations and other terms which might otherwise be implied by statute, common law or the law of equity.
  • Any responsibility or liability for any direct, indirect, special and/or consequential loss or damage incurred by any user in connection with the Website or in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted on it (whether caused by tort, breach of contract or otherwise, even if foreseeable).

Your personal information

Use of your personal information submitted to or via the Website is governed by our Privacy and Cookie Policy. By using our Website, you consent to such processing and you warrant that all data provided by you is accurate.

Links from our Website

Where our Website contains links to other sites and resources provided by third parties, these links are provided for your convenience and information only. We have no control over the contents of those sites or resources, or for anything provided by them and do not guarantee that they will be continuously available. We accept no responsibility for them or for any loss or damage that may arise from your use of them. The fact that we include links to such external sites does not imply any endorsement of or association with their operators or promoters. In the event you link to any such third party site you do so at your own risk.

Third party material

You may see advertising or other material submitted by third parties on the Website. Any third party uploading or submitting content or information for inclusion on the Website is solely responsible for such content and information, including ensuring that it complies with all relevant legislation and/or common law, regulations and/or codes of practice. We accept no responsibility or liability for the content of advertising or other third party material submitted to the Website including without limitation the lawfulness of such content or any error, omission or inaccuracy therein.

General

Nothing in these terms and conditions shall limit or exclude our liability to you:

  • for death or personal injury caused by our negligence;
  • for fraudulent misrepresentation; 
  • for breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded; or
  • for any other liability that, by law, may not be limited or excluded. 

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to and/or use of the Website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These Terms & Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
